Court's powers in respect of quashing orders

54.19

(1) This rule applies where the court makes a quashing order in respect of the decision to which the claim relates.

(2) The court may –

(a)

(i) remit the matter to the decision-maker; and

(ii) direct it to reconsider the matter and reach a decision in accordance with the judgment of the court; or

(b) in so far as any enactment permits, substitute its own decision for the decision to which the claim relates.

(Section 31 of the Supreme Court Act 19814 enables the High Court, subject to certain conditions, to substitute its own decision for the decision in question.)

Requesting changes to parking controls

We will consider requests for new controls or changes to existing ones in the parking review for your area on the following basis:

  • Where we believe on street parking has a detrimental impact on road safety or the passage of vehicles or pedestrians, we will generally include these for assessment in a parking review, even if just one person has brought the issue to our attention. Examples of this might include preventing parking too close to junctions or in places that cause problems for the passage of larger vehicles, such as emergency vehicles, buses or refuse lorries.
  • With larger schemes, we will only investigate the possibility of new controls if we have evidence of the support of at least 70% of the properties in the street that are likely to be directly affected. Examples include requests for residents permit parking or other parking management schemes. The reason for this is that the development of parking management schemes can be expensive and time consuming. We want to know that there is a reasonable level of support for changes by residents (or other highway users) who will be affected before we start an investigation.

Before we can look at introducing a parking management scheme, usually where there is too much demand for the amount of available parking space in a street, such as a residents' parking permit scheme or yellow lines in a whole road or larger area, we need residents of that area to demonstrate support by submitting a parking scheme request. We generally require at least 70% of those households who will be directly affected to sign up to the scheme. Please note that submitting a scheme request, even with at least 70% signed up, does not mean that the scheme will necessarily go ahead, as it may not be appropriate for it to do so. However it does mean that we will give it serious consideration.

Time limit for filing claim form

54.28

(1) The claim form must be filed not later than 6 months from the date by which a response to a decision notice was required under section 36(3) of the Environment Act 2021.

(2) The time limit in paragraph (1) may be extended, but only upon application to the court by the claimant and if the court is satisfied that it is reasonable to do so.

Terms of Reference 

1.To carry out an independent review of the effectiveness of current policy and service provision relating to mental health and learning disability, and of the Mental Health (Northern Ireland) Order 1986

2. To take into account:

  • the need to recognise, preserve, promote and enhance the personal dignity of people with mental health needs or a learning disability and their carers;
  • the need to promote positive mental health in society;
  • relevant legislative and other requirements, particularly relating to human rights, discrimination and equality of opportunity;
  • evidence - based best practice developments in assessment, treatment and care regionally, nationally and internationally;
  • the need for collaborative working among all relevant stakeholders both within and outside the health and personal social services sector;
  • the need for comprehensive assessment, treatment and care for people with a mental health need or a learning disability who have offended or are at risk of offending; and
  • issues relating to incapacity. 

3. To make recommendations regarding future policy, strategy, service priorities and legislation, to reflect the needs of users and carers.

Applications and Referrals under the Order

The Tribunal has a statutory role to consider applications/referrals made for the discharge of patients under Part V of the Order.  This includes applications made on behalf of the patient by their nearest relative.  Additionally, if a patient's detention/guardianship has not been considered by the Tribunal by the end of a period specified in the Order, the Secretary of State or the responsible Trust are obliged to refer the case for consideration, thus ensuring that all cases are subject to regular review.

The Tribunal may direct that a patient is discharged or that they remain subject to detention.  It has different powers and procedures in respect of restricted patients (i.e. those who have been accused or convicted for criminal offences and on whom the Crown Court has imposed restrictions on discharge).  In those cases the Tribunal may direct an absolute discharge, a conditional discharge or may defer a direction for a conditional discharge.

See your GP or asthma nurse:

  • within 24 hours if your asthma symptoms have been getting worse, you need to use your reliever inhaler three or more times a week, or you've had an asthma attack.
  • within two working days if you've had to go to hospital with an asthma attack.
  • within four to eight weeks if your prescription has changed.
  • after 12 weeks if you've had no symptoms. Depending on your triggers and the pattern of your symptoms, your GP or asthma nurse can talk about keeping you on the same dose of medicines, or reducing your dose. They will aim for the lowest dose of medicine needed to keep you free of symptoms.
  • a month before your hay fever season. Managing hay fever symptoms is an important way of managing your asthma. Your GP or asthma nurse may also increase your asthma treatment beforehand to give you extra protection.

The Tribunal President will make every effort to ensure that the hearing is conducted as informally as possible.  At the beginning he/she will introduce everyone present to you and will explain the procedure to be adopted.

The Tribunal panel will have already read the written reports submitted as evidence.  It will hear the evidence of the witnesses present and it will take into account anything that you or your representative has to say.  All the parties will be given an opportunity to ask questions.
