Legal gambling began in Wisconsin in the 1960s with the authorization of charitable gambling via ballot measures. In the 1980s, a constitutional amendment legalized the state lottery, and horse and dog racing tracks were allowed to offer pari-mutuel betting.

Numerous Native American tribes in Wisconsin were excited when Congress passed the Indian Gaming Regulatory Act in 1988, which allowed them to work with their state governments to devise gaming compacts. Those negotiations began quickly but took longer than anticipated, though various types of tribe-run casinos began opening in the 1990s. Today, there are nearly two dozen facilities open throughout the state.

The Wisconsin statutes define many terms that pertain to illegal gambling, including bets, gambling machines, and gambling machines. Essentially, the bottom line is that anyone who makes a bet or goes into a gambling place intending to bet can be found guilty of a misdemeanor.

Games of chance are referred to often in the statute, but the most detail given is by the State of Wisconsin Division of Gaming, which operates under the Department of Administration. madison_casinomadison_casinoThe Ho-Chunk operate a casino in the state’s capital of Madison, Wisconsin. As of the time of this writing, the casino operates from 10:00a-2:00a on weekdays and until 5:00a.m. on weekends.

This sizeable casino (by Native American Casino standards) is home to more than 1,000 slot machines, but strangely, does not have a hotel on the property. Additionally, you wouldn’t even know that the building is a casino if not for the exterior signage. Slot, video poker and video keno denominations range from pennies to $5 and their website claims that the average return-to-player on the slot floor is 95%. I would expect that this number is propped up by video poker, but 95% is still really good even with that being considered.

As of the time of this writing and due to Covid-19, there is no food whatsoever being sold at the property, although alcoholic beverage service is apparently available. I guess getting drunk is essential, but eating, not so much.

Normally, the property’s only eatery would be Gamer’s Grill, which has a casual American food menu at also casual American food prices. As mentioned, that is closed for the time being, but is expected to reopen when Covid-19 is behind us.

This property does not seem to operate Table Games even when there’s not a pandemic going on.

If you happen to be in the area of this casino, then it’s probably going to be worth taking a look around to see if there are any machines you like. Just be forewarned that it essentially amounts to an overgrown slot box with not a whole lot else going on.

Wisconsin Gambling History

Wisconsin voters approved two new forms of gambling in 1987. A state lottery was approved that year. The first ticket was sold the following year on September 14. Horse and dog racing were also legalized in 1987. The first track opened in 1990. At one point there were five tracks in operation in Wisconsin. Tribal casinos destroyed the demand for racing in the state. Dairyland Greyhound Park was the last to shutter. That happened on December 31, 2009.

Governor Tommy Thompson signed the first gaming compact with a tribe in 1992. A total of 11 pacts were signed that year.

Ho-Chunk Madison has been unable to secure approval from local voters to operate table games. The casino rolled out electronic poker tables in the mid-2000’s. The state sued the tribe in an attempt to have a judge declare the games to be illegal. The state prevailed. The games were removed in 2014. The decision was overturned but the tribe still decided to remove the devices.

History of Gambling in Wisconsin

Gambling in Wisconsin predates the arrival of European settlers. The moccasin game was a native gambling game where one player would hide a small object underneath one of four moccasins, and the other would try to guess where it was. The tribes of the area often engaged in chunkey, a game involving throwing a spear at a rolling stone in an attempt to come the closest to the final stopping point of the stone. Gambling on who would win was a favorite pastime. A chunkey stone dating from between 1300 - 1600 has been unearthed near La Crosse.

La Crosse was the site of other gambling activity later on. Despite the fact that the Wisconsin constitution of 1848 prohibited gambling, La Crosse's location at the junction of the Mississippi, Black, and La Crosse rivers meant that it was a focal point for transient visitors looking for games of chance. Saloons sprouted up during the 1850s, containing not just drink but also gambling and sometimes prostitution. These establishments often disturbed the peace at all hours of the day and night, and an angry mob gathered on July 6, 1857 and burned one of the largest of them to the ground. This marked a turning point in the city, which then decided to hire policemen and clean up its act.

Another municipality that became infamous for its vice scene was Hurley in the 1880s. It was built on the Wisconsin/Michigan border expressly to serve the needs of lumberjacks and miners. These hardworking men, after weeks or months at their job sites, would head into Hurley to spend their accumulated pay. In 1893, Hurley hosted 60 saloons – an amazing total for a town with a population of just over 2,000. This trade continued into the 20th century and the Prohibition era. The saloons were converted into “soft-drink parlors,” but they served harder stuff upon request, and there was often a card game or two occurring in their back rooms.

During this same era, wagering on dog racing became briefly popular. In order to get around the laws, spectators would “contribute” to their favorite dogs. If a dog so selected came in first, second, or third, the bettor would receive a “refund.” In 1929, however, the legislature passed a law deeming this “refund” system to be illegal. Another type of gambling that appeared was slot machines particularly in the area around Elkhart Lake. The lake was home to many resorts, which endeavored to boost their profits with slots. Local police ignored these infractions, but the state got involved and started to raid these properties in 1930. By 1945, slot gaming had been basically stamped out.

In order to permit most forms of legalized real money games, Wisconsinites had to amend the constitution, which still contained a blanket ban on gambling. The first game to pass this hurdle was charitable bingo, which was authorized in 1973. Next came charitable raffles in 1977. The Wisconsin Lottery arrived in 1987. In the same year, on-track, pari-mutuel betting on horse, dog, and snowmobile races was authorized. Of the three types of racing, only dog racing has actually materialized within Wisconsin. However, the last greyhound racing facility closed down in 2009, and so this form of wagering, while still legal, can't be found within state borders.

In the late '80s, a lot of legal wrangling commenced between state leaders and tribal groups that wished to set up gaming casinos. There were a few setbacks, but by 1992, the state had signed compacts with 11 tribes, and the first casinos opened up shortly thereafter.

Wisconsin Tribal Sports Betting Growing

The deal is the latest between the governor’s office and a Wisconsin tribal group regarding casino wagering. In February, the Forest County Potawatomi Community came to an agreement with Evers to allow sports betting at two tribal properties, one in Milwaukee and the other in Forest County, about 200 miles north.

The latest deal, according to a news release from Evers’ office, allows wagering at the Lac Courte Oreilles Band of Lake Superior Chippewa Indians’ Sevenwinds Casino in Hayward, plus allows for “mobile wagering on other land” on the reservation.

“I am grateful to Chairman Taylor and the Lac Courte Oreilles Tribal Council for their work to come to an agreement on this important compact amendment,” Evers, a Democrat elected in 2018, said in the release. “Event wagering will generate additional revenue for the state and the Tribe, while giving a boost to tourism and employment in Northern Wisconsin.”

This casino was closed for the better part of the year due to Covid-19, but it is scheduled to reopen on February 1st, 2021.

In terms of the lodging, the main change taking place when they open is that there temporarily won’t be any. However, the property usually features a hotel consisting of 75 guest rooms and suites with amenities including a business center, wireless internet access, indoor pool and fitness center.

The casino would normally feature a Bingo room, but that is going to be temporarily closed as of the time they reopen. Table Games will also be temporarily closed, but that doesn’t matter unless you like Blackjack, because that was the only table game (six tables) they had anyway.

Covid-19 probably has an impact on the eateries, but Cafe Manoomin would normally be a casual American dining establishment that serves breakfast, lunch and dinner. Ban’Gi Bistro is located inside of the Bingo Hall and is a glorified concession stand, because Bingo is not operating, this won’t be either until Bingo reopens. Windtalkers is the casino’s main bar located in the center of the casino, but would normally serve appetizers, pizza and other quick eats.

Personally, I’m not a fan of these half measures, because it’s tantamount to admitting that you only;y really care about the slot machine revenue. If you’re going to reopen, other than social distancing measures, just reopen. If not, stay closed. In any event, there’s really no reason to visit this one unless you happen to be in the immediate area anyway, Covid or no Covid.
