Online casino laws in the United States

Casino gaming is legal in many states in the US. However, this does not mean that online casino gaming is permitted in all states with bricks and mortar casinos.

In fact, some states have passed legislation to prohibit all forms of remote gambling (gambling via the internet) even though they have thriving retail casino industries.

One important fact though is that there is currently no federal law that prohibits online casino gaming or online gambling of any kind. This wasn’t always the case though as back in 2006 President George W. Bush signed the Unlawful Internet Gambling Enforcement Act (UIGEA). While this law didn’t specifically target online casino gaming, it did make it illegal for businesses to transfer funds to and from online gambling companies.

The UIGEA didn’t come into effect until 2010 at which point many online poker companies had already pulled out of the US market. A few remained and would pay the ultimate price.

On April 13th, 2011 the U.S. Department of Justice unsealed a 52-page indictment that named executives of PokerStars, Full Tilt Poker, and Absolute Poker. The indictment also included a civil complaint against the companies that sought $3 billion in assets from the sites. As you’d expect, this had a negative impact on the potential for regulated casino gaming.

However, the Department of Justice later that year published a revised opinion on the Federal Wire Act that indicated that it only applied to sports betting. The Federal Wire Act had previously been used in conjunction with the UIGEA to determine if any state laws were broken but the DoJ’s new stance on the Act opened the industry up for possible legalization and regulation on a state-by-state level.

Since then, several states have moved to legalize online casino gaming, but the US Supreme Court’s decision that the Professional and Amateur Sports Protection Act of 1992 (PASPA) was unconstitutional put all the focus back onto sports betting.

This means that online casino regulation in many individual states has stalled as lawmakers push through legislation for the more lucrative sports betting industry.

At the time of writing there are six states that have legalized online casino gaming:

• Connecticut
• Delaware
• New Jersey
• Michigan
• Pennsylvania
• West Virginia

Legislation has also been proposed in the following states:

• Illinois
• Kentucky
• Louisiana
• Massachusetts
• New Hampshire
• New York

New York seems the most likely candidate for legal online casino gaming in 2022 as two bills have been proposed that seem to have garnered enough support to be pushed through. Meanwhile Kentucky has added a companion bill legalizing online poker to a sports betting bill that has been passed in the house in March of 2022. Lawmakers will now decide during the summer whether or not to move ahead with it.

It’s worth noting that there are also a number of grey states where there is no specific prohibition of online casino gaming in state legislation. In these states, international gambling companies will often serve the market, but these companies are not regulated and have no rules or restrictions regarding how they conduct their gambling business.

Gambling Taxation in Romania

One of the most common questions for gamblers to ask is whether or not they have to pay any taxes on gambling winnings. In Romania, there are numerous gambling taxes, some of which are paid by players.

First off, Romanians must pay 2% tax on all deposits made to casinos. This is pretty harsh and somewhat out of line with the rest of Europe, which tends to place income tax on the operators rather than on the customers.

Further to this players must pay tax on all gambling winnings in Romania. The rate at which winnings are taxed ranges from 1% on winnings of less than 75,000 RON up to 25% on winnings of more than 500,000 RON.

Players must pay a 2% tax on all deposits made to casinos in Romania and between 1% and 25% on all gambling winnings.

As we mentioned above, the tax situation in Romania is very harsh on the players. While there are taxes on the operators as well, it really seems as though the government puts the interests of the companies ahead of the players here. This is a real shame and a decision that we find disappointing, especially when you compare this to any of the other European markets.

Canada

Canada is divided into ten provinces, each a self-governing entity empowered by the federal government although significant changes require alteration to the nations constitution.

Gambling provides a much-needed income to non-profit organizations and casinos are legal and prevalent throughout the nation, especially in British Columbia, Alberta, and Ontario.

Kahnawake Commission: The Kahnawake Commission is an interesting anomaly. Located in Quebec the Mohawk territory of Kahnawake saw the potential of online gaming in 1996, subsequently setting up the Kahnawake Gaming Commission of that year. As an Indian reservation and thus a sovereign legal entity, the Mohawk commission is not bound by Canadian law and thus has the jurisdictional right to license and regulate offshore online gaming sites.

Initially, the Kahnawake Commission was a popular licensing authority with many of the older Microgaming brands licensed there. REGARDING THE ADMINISTRATIVE HEARING PROCESS

How is a Compliance Meeting different from a Show Cause Hearing?  A Compliance Meeting is offered to permanent licensee/permittee in an effort to bring the licensee/permittee into compliance in an informal manner. Should there be no resolution at the Compliance Meeting, a Show Cause Hearing will be scheduled for a Hearing Officer to make a determination in the matter. A gaming applicant or a temporary licensee who has been denied a license is not afforded this step and will proceed directly to the Show Cause level.

How will a hearing proceed?  The Hearing Officer will open the hearing and then ask the Division witness to expound upon the allegations. Then it is the Respondent’s turn to address the charges. Documents may be produced as evidence by either party. At the end of the Hearing the Division witness may make a recommendation for the Hearing Officer’s consideration and the Respondent may make a final statement.

Who will attend?  There is a Hearing Officer presiding over the hearing and a presenter who address the allegations. Personnel presenting cases might be from the CLC collections section, the security unit, the gambling regulation unit or the charitable games unit. Additionally, there may be witnesses from the units mentioned above or from the field.

How long will it take to get a decision in the matter?  A decision will not be rendered that day. The Division has 90 days to make a decision but generally the decision is rendered in approximately one month.

What kind of documentation may be brought to the hearing?

Letters of recommendation and work performance evaluations are frequently offered by Respondents. Generally, a Respondent can bring any documentation he/she believes would benefit him/her in the case. The Hearing Officer will accept any documentation and give it the weight it deserves.
