Recently, however, this has changed. Not only are “racinos” now common in the state, like for example in Delaware, but full resorts have been built with more on the way, a response to the increasingly competitive gambling market in the Northeast. With this expansion has also come a call for the regulation of online gambling, though it remains to be seen how much movement will occur on this front.

Online gambling in New York is not legal, yet. It’s assumed that it will only be a matter of time before people are allowed to play online, and it’s perfectly legal for players in New York to gamble as long as they are doing so at an online casino outside of the US.

Gambling laws differ state by state and New York is one such state that has enjoyed a colorful history within the world of gambling. Sports betting in New York stretches back further than you might imagine. Sports betting has been legal in the Empire State since 2013. The New York Casino Gambling Amendment made the construction of four commercial casinos possible in upstate New York as a means of boosting local economies. Part of the law included provisions for retail sports betting.

However, the legalization was mostly symbolic at the time. After all, the federal ban on sports betting, the Professional and Amateur Sports Protection Act (PASPA), remained in effect until 2018 and superseded any state law that might have said otherwise.

As much as New Yorkers will hate to hear this, they owe a debt of gratitude to New Jersey. Like New York, the Garden State had a law in place to allow for sports betting. However, New Jersey decided that it wanted to fight back against the prohibition and sought relief in court. Despite suffering numerous setbacks on several court levels, Garden State representatives finally prevailed at the United States Supreme Court in May 2018. Thus, the federal ban lifted and left the decision over sports betting to the states.

Retail sports betting began in New York in July 2019, just over a year after sports betting became a valid activity for states to adopt. Unfortunately, the 2013 amendment included no provisions for online betting, so New Yorkers were consigned to travel to the four commercial casinos or several tribal casinos to place a wager. Most of these locations were not convenient for downstate residents, and many preferred to cross the border into New Jersey to bet.

New York finally got its act together in 2021 and passed a law to allow for online sports betting. The bill that finally made it to the books contained, among other things, a mandated tax rate of at least 50% of gross revenues collected by the sportsbooks. Although this rate was an issue at the time and remains an issue for sportsbooks’ longterm prospects, the immense opportunity that New York’s population offered was too great to ignore. Thus, the first online sportsbooks appeared in New York in January 2022.

As highlighted above, there are a few rules and regulations surrounding Senator Addabbo’s proposed Senate Bill 8412, the legislation that hopes to bring regulated online casino gaming to New York. The bill still awaits consideration from the Senate Committee on Racing, Gaming, and Wagering, but if and when it eventually gets passed, it would require the following terms:

• Each land-based New York casino would be allowed to host up to two (2) mobile skins.
• Land-based casinos would be required to pay a one-time fee of $2 million, while third-party iGaming providers would be charged $10 million.
• Third-party operators can use their own branding, but would be required to display their land-based casino partner’s logo somewhere clearly on their app or website.
• All operators would be subject to paying a 25% tax on all gross iGaming revenue.
