Summary: Gambling is legal in Mexico since 1947, on a federal level (officially the United Mexican States, a poorer Northern American country country, a signatory of NAFTA, has a population of 128.9 million). 1771: The first written form of gambling predates the independence of Mexico (1821). The first form of officially legal gambling on the territory of modern day Mexico (back then New Spain) was the Royal General Lottery, which donated most of its profits to charity, and it operated the New Spain’s Hospice for the Poor (which was a huge homeless shelter, house of the poor, free clinic and home for the disabled all in one).
/Comment: Back in the 18th century gambling really had a bad reputation, because people were actually religious, and according to the Bible true Christians (who are actually religious, not just say so, like today) must not participate in any sort of game of chance.
However, if the wagering operation served a socially beneficial purpose, the church authorities often officially sanctioned it, which bypassed the religious dogma./
1920: Commercial gambling has been legalized in Mexico in 1920 for the first time.
1920 – 1935: The golden age of gambling in Mexico was from 1920 to 1935, when the country was a favourite among American tourists, especially budget travelers, which could only afford this nearby destination (it’s still true today btw.).
And because gambling was illegal in almost every US state at that time (UPDATE 2022: now the opposite is true, there are casinos in almost every US state) tourists spent heavily on gambling activities, despite the language barrier and then underdeveloped hospitably & tourism sector.
1935 – 1947: President Lazaro Cardenas made all forms of gambling illegal, when he took office in 1935, the complete gambling ban lasted until 1947.
/Comment: Gambling.com, a very well known gambling website that has been around forever is completely wrong on this subject, they say on their page about Mexican online gambling sites that gambling was only partially banned, and the ban was extended to all forms of gambling in 1947, and gambling was only relegalized in 2004.
This is completely false. This is a great example of when a big, popular website gets something wrong, and then it becomes common knowledge, because of their clout.

1947: Lottery and sports betting were relegalized.
2004: Gambling legislation was updated with the passing of Regulations of the Federal Games and Draws Law 2004 and new forms of gambling were legalized, including online gambling.
/Comment: Even Regulations of the Federal Games and Draws Law 2004 does not address online gambling specifically, it has been interpreted in a such a way that it applies to internet games of chance. Which means, this is the official date of the legalization of online gambling in the United Mexican States./
Mexico is a federal republic, therefore, there are differences in how gambling is regulated in each state. Luckily, gambling is mostly regulated on a federal level in Mexico (except for gambling taxes, see below, at the Mexico gambling taxation section, and zoning restrictions).
And even though differences do exist, these are nowhere near as big as in the USA, their Northern neighbour.
Gambling is legal in Mexico, since 1947 (on a federal level), with strict restrictions, according to Ley Federal de Juegos y Sorteos1 (a.k.a. 1947 Feder Gambling Law).
The gambling sector, especially the casinos are strongly reliant on tourists from the USA, and the government also imposes several restrictions to protect locals (details can be found in the Mexico casinos section, below, but locals are not actually banned from visiting these casinos, unlike in the Arab world, where only tourists can enter casinos in most countries, e.g.: Egypt).
Foreign companies are not really welcome in the Mexican gambling industry (this is due to historic reasons, during the 1920s, 30s, American organized crime gangs and other unsavory elements dominated the casino industry in Mexico), most licences are only available to Mexican companies and individuals (although partnerships are possible, see below, in the Mexico gambling licensing section).
There are about 230 casino gambling venues in Mexico. The big casinos are usually part of a resort, hotel complex and target affluent tourists, while the small Mexican slot halls only have old, second hand slots, don’t have anything available in English (most of them don’t even have websites), and are cheaper, and have lower service quality.
The government aims to increase the number of these venues but it is actually decreasing despite these efforts. In 2015 there were 291 gambling establishments.
UPDATE COVID-19: The coronavirus pandemic decimated the gaming venues of Mexico, as much as 20 have already closed their doors permanently, and many more will follow suit. There also have been talks of revising the outdated gambling laws, and letting in more foreign investment, but so far, these did not materialize.
UPDATE 2022: The proposed changes mentioned above did not yet happen, at the time of writing, there were no significant changes to the gambling legislation yet.
Online gambling is also legal in Mexico, in a limited form, since 2004, according to the Regulations of the Federal Games and Draws Law 20042, which is the main piece of the gambling legislation.
The Ministry of the Interior is in charge of licensing gambling establishments and it has granted a few remote gambling licenses to:
- online sports betting companies (Ladbrokes),
- online poker companies (Amaya),
- and online lottery companies (Jumbo Interactive and Sorteo Games).
These gambling companies are known to be partnered with a licensed and legally operating companies in the country (you can see some of the licensed online gambling websites below), and these websites can accept Mexican players legally.
/Comment: Due to licensing requirements, only Mexican companies can get a remote gambling license, but partnership are possible with foreign companies, that’s the only way to obtain a Mexican license currently, through a partnership or leasing the licence of a Mexican licence holder./
In 2014 a new online gambling law was proposed in Mexico, aiming to create specific online gambling laws. First it was postponed till 2015, and then it was postponed indefinitely, and the nothing came of it.
Regardless, the online gambling market is growing in Mexico, despite the technical issues and outdated regulation, but it’s far from it’s true potential.
The new gambling legislation will have a huge impact on the gambling industry in Mexico, but it’s unlikely that it will materialize anytime soon.
Players from Mexico are free to play on foreign online gambling websites, which are licensed and accept registrations from the country (see below).
However, unlicensed online wagering platforms are illegal and placing bets on such websites is illegal.
However, in practice, unlicensed gambling platforms are not blocked, and players are not prosecuted. Still, we do not recommend playing in unlicensed online casinos, it’s illegal. Also, winnings from unlicensed, illegally operating gambling establishments are taxable, only winnings from licensed online casinos are tax exempt (details can be found in the gambling winnings taxation section below).

Yes, the laws discussed on this webpage only apply to Mexican citizens, and does not apply to tourists. Tourists (expats, non-citizens, illegal migrants) can play online freely. Gambling Laws in New Mexico — The Law Overview
The first legal form of gambling in New Mexico was introduced in 1947 when the local lawmakers legalized horse racing betting.
