BCLB said in its letter that the scenario had "provided a fertile ground for unauthorised gaming activities".

"(It) has also affected the general messaging of prize competitions and lotteries to a menial 'send this and win that' without informing the public what competition or lottery they are engaging in. In a nutshell, this situation has turned some radio stations into betting shops while totally disregarding the watershed hours and the gaming advertisement guidelines," it said.

"In order to address this abuse, radio stations will not be allowed to carry out any lottery or prize competition draw unless the said radio station has a gaming permit to do so," BCLB added.

The letter was copied to CA, MCK and the Media Owners' Association.

It also added that pay bill and account numbers being announced for competitions should be in the names of the permit holders and not the radio stations.

"Any licence permit holder who fails to adhere to this directive shall have their licence or permit withdrawn," BCLB said, adding that radio stations that will defy the directive will be treated as having defied the Gaming Act that requires any lottery organiser to be registered.

In addition, a clause was added specifying that any person found in possession of documents related to illegal bookmaking shall be presumed to be running an illegal gambling operation.

While the amendments were scheduled to be debated in Parliament on 15 October, it was later moved off of the day’s schedule, meaning it will not be debated until after the National Assembly returns from recess on 3 November.

Kenya’s betting landscape has been in disarray since 2019, when a dispute between authorities and operators over tax led to its two leading operators ceasing operations in the country.

Kenya’s largest operator Sportpesa saw its mobile money transfers – then permitted under the previous Gaming Act – suspended after the BCLB informed operators that a 20% tax on winnings should be interpreted to include players’ stakes, and that it was owed billions in back taxes based on this interpretation.

The operator then withdrew from its home country, as did rival Betin, after an additional excise tax on stakes was raised from 10% to 20%.

While courts later ruled the winnings tax should not apply to stakes and the National Assembly removed the exise tax entirely in June, Sportpesa has not yet returned as Kenya’s government has announced plans to reintroduce the excise tax before the end of the year.

Just recently, the National Assembly’ Sports, Culture and Tourism Committee in Kenya amended the 2019 Gaming Bill in order to allow gambling operators including online casinos in Kenya to accept mobile payments from various mobile payment platforms. This was a long thing coming considering the country has over fifty-eight million subscribers using mobile money platforms.
