Many forms of gambling are legal in France, and there are threemain bodies responsible for its regulation. The Pari Mutuel Urbaindeals with horse racing, the Francaise des Jeux deals with bettinggames and lotteries, and ARJEL deals with online gambling. In 2010three forms of online gambling were officially legalized.
There are three types of licenses for the three forms of onlinegambling activities that are allowed by the French law:
- online sports betting (live betting, pool betting and fixed odds betting);
- online horse race betting (pool betting); and
- online poker game.
At this time licenses aren't issued for casino games, spreadbetting, or exchange betting. The philosophy behind thisdecision is that these forms of gambling are highly addictive.Poker is one of the games played at casinos, but it is legal,because the outcome of the game depends on the skill of the player,who can alternate their strategy depending on the gamesituation. To date, there are no other gambling activitiesauthorised under the French law.
Betting and Gaming Act Benefits
Bookmakers operated before gambling in the UK was legalised, but they were underground activities that had questionable legality. After the government, who regulates gambling in the UK, introduced the Betting and Gaming Act, people all over the country could bet without getting into trouble.
The Act was created on the recommendations of the Royal Commission on betting, Lotteries and Gaming and was intended to minimise illegal gambling on the streets. Of course, there were other benefits too; for instance, as soon as casinos were made legal, they turned into taxable enterprises, meaning the government could benefit from an increase in tax earned from betting shops. However, the government did what they set out to do – with casinos and betting shops open to everybody, it wasn’t long before street gambling became a thing of the past.

"Gambling" for the purposes of this section covers:
- gaming, betting and other activities defined as gambling by the Gambling Act 2005 (as amended); and
- spread betting as defined in financial services legislation.
Rules on marketing communications for lotteries are set out separately in Section 17.
The legal framework for gambling in Great Britain, including the requirements for licensing gambling operators, is set out in the Gambling Act 2005 (as amended). The Gambling Commission regulates commercial gambling and permits gambling on the basis that the licensing objectives to keep gambling safe, fair and crime out, are met.
To advertise in Great Britain, and to advertise remote gambling in Northern Ireland, gambling operators must comply with the relevant licensing requirements set out in statutes. The ASA will refer marketing communications for unlicensed operators to the Gambling Commission. The Gambling Commission’s Licence Conditions and Codes of Practice make it a direct requirement on licensed operators to ensure their marketing communications comply with the UK Advertising Codes.
The Gambling Act 2005 and Gambling (License & Marketing) Act 2014 apply to Great Britain and Northern Ireland for remote gambling.
Specialist legal advice should be sought when considering advertising any gambling product in Northern Ireland, the Channel Islands or the Isle of Man. The ASA will cooperate with the relevant authorities to address complaints relating to these jurisdictions.
Spread betting may be advertised as an investment under the Financial Services and Markets Act 2000 (as amended) (FSMA), the Financial Services and Markets Act 2000 (Financial Promotion) Order 2005 (as amended) and other Financial Conduct Authority (FCA) rules and guidance (see Background, Section 14, Financial Products). A "spread bet" is a contract for difference that is a gaming contract, as defined in the glossary to the FCA Handbook.
There is no sector-specific EU legislation in the field of gambling services. EU countries are autonomous in the way they organise their gambling services, as long as they comply with the fundamental freedoms established under the Treaty on the Functioning of the European Union (TFEU), as interpreted by the Court of Justice of the EU. The freedom to provide services or to open a business in another EU country is particularly relevant here.
Most EU countries allow at least some games of chance to be offered on the internet. Some countries allow all games, while others only allow certain types such as betting, poker or casino games. In some European jurisdictions, monopolistic regimes offering online gambling services have been established. These are run by a state-controlled public operator or by a private operator on the basis of an exclusive right. However, a growing number of EU countries have established licensing systems that allow more than 1 operator to offer services on the market. Under EU law, no particular system is favoured over the others.
Which Countries Allow You to Gamble Online?
There are only a few places in the world where online gambling is completely legal. These include Canada, the United Kingdom, most countries in the European Union, some countries in the Caribbean, and some states in the USA.
In most other countries, online gambling is banned or at least heavily restricted. However, many of these countries don’t enforce this ban as strictly as they could.
